INDEMNITY AGREEMENT

This Agreement is made by and between MyDogsAdventures (hereinafter called "MDA”) and the Pet Owner whose name and whose signature appears below (hereinafter called “Owner”). For the purposes of this Agreement, the term “Pet” refers to the dog(s) under said ownership of Owner. The following are the terms of service for the provision of pet care services (“Services”) of the Owner’s Pet by MDA. By proceeding with the booking, you accept and agree that the booking shall be on the terms and conditions as follows:

1. DISCLOSURE
   1. Before leaving your Pet with MDA, Owner certifies to the accurate disclosure of all information provided to MDA either in writing or orally about the Pet. Owner agrees to provider all necessary information about the Pet’s health, behaviour, and special needs. Owner specifically represents that he or she is the sole owner of the Pet and is authorised to engage MDA.
      
   2. Owner specifically represents to MDA that Pet is healthy and has satisfied NParks’ vaccination requirements. Owner represents that each time Pet is brought to MDA, Owner is recertifying that Pet has not been exposed to any communicable illnesses of any kind of 30 days prior to visit and has not injured or displayed aggressive behaviour toward any person, dog or other animals.
      
   3. Owner further agrees to inform MDA of any changes in Pet's condition and/or behaviour prior to subsequent visits.
      
   4. MDA reserves the right to refuse service to any Pet for any reason, at any time, including, but not limited to: pets lacking proofs of vaccinations, pets displaying signs of untreated or potentially contagious conditions and/or pets exhibiting aggressive or unacceptable behaviour.
      
2. SERVICES
   1. MDA agrees to provide pet sitting, dog walking, and other applicable Services for the Pet in a professional, caring and trustworthy manner.
      
3. ACTS OR BEHAVIOUR
   1. Owner agrees to be solely responsible for any and all acts or behaviour of Pet while in the care of MDA, including expenses arising from injury to MDA employees, other pets or damage to facilities caused by the Pet. Owner also acknowledges that muzzles and crate may be used by MDA for the protection of other pets or employees.
      
4. INDEMNITY
   1. Owner agrees to expressly waive and release MDA and its employees from any costs, damages or claims of any kind that arise from:
      1. (a) Sickness, injury, escape, damage or death of the Pet during the Services, unless caused through gross negligence or wilful misconduct on the part of MDA; and
      2. (b) Injury or damage caused by the Pet to other animals, people, or property during the Services.
         
   2. Notwithstanding, MDA shall exercise all necessary precautions against sickness, injury, escape, or death of Pet.
      
5. ASSUMPTION OF RISK
   1. Owner acknowledges that there are inherent risks including but not limited to;
      1. Injuries sustained during the course of playtime with other dogs, even under MDA’s supervision;
      2. Injuries sustained by the Pet and/or other dogs in the course of a fight; and
      3. Transmission of communicable diseases amongst dogs as they may be in close proximity.
   2. Owner assumes all risks associated with their dog's participation in the dog day-care and releases MDA from any liability for any injury or damage caused to their dog while in MDA care.
      
6. MEDICAL ATTENTION
   1. In the event of injury, emergency or when MDA, in its sole discretion, deems medical care is important to Pet's health (including, but not limited to: vaccinations, fleas, ticks, diarrhoea, rashes, etc), Owner authorizes MDA to obtain medical attention for Pet from its personal veterinarian, or in the absence of such availability, certified veterinarians.
      
   2. In such event, Owner grants MDA and the veterinarians the full power of decision-making involving the medical treatment of Pet (including but not limited to: consultation, medicine, surgery, medicine, hospitalisation, intensive care life support, euthanasia, anaesthesia, transport and care to and from any agent) and agrees to pay for all costs associated with said medical treatment.
      
   3. MDA agrees to act with urgency and compassion to ensure the necessary care is rendered to the pet.
      
7. MARKETING
   1. Owner authorizes the use of pictures of Pet on website, social media and/or marketing materials for promotional purposes.
      
8. CONFIDENTIALITY
   1. MDA shall ensure that any personal information shared by the Owner is handled in accordance with privacy laws as stipulated in the PDPA (Personal Data Protection Act) and is not disclosed without consent.
      
9. GOVERNING LAW
   1. These terms and conditions will be governed by and construed in accordance with Singapore law, and any disputes relating to these terms and conditions will be subject to the jurisdiction of the courts of Singapore.
      
10. ACKNOWLEDGEMENT
    1. The Pet Owner acknowledges that they have read and understood this Agreement and agrees to its terms.
